Termination of Contracts and Force Majeure Under Qatari Law and Its Islamic Law Influences: Emergence of a Transnational Gulf Private Law

There is a growing interest in the private laws of Gulf states, and particularly Qatar, because applicability such transnational local contracts that account for significant volume global trade, energy construction. Islamic law has negligible, if any, impact on relating to termination contracts, including hardship force majeure. Termination Qatar chiefly regulated by Qatari Civil Code other specialist legislation, as well significantly country’s Court Cassation, which produced consistent flow case binding lower courts. The generally follows rule parties may not unilaterally terminate any event sufficient notice required. As regards unforeseen circumstances, distinguishes between general circumstances render performance impossible. former be amenable adaptation courts, whereas latter effectively serves parties’ respective obligations. allows waive majeure claims their contracts.
